A NSW company with comprehensive safety systems and a risk management manual was recently fined $110,000 for failing to undertake (or ensure) a risk assessment was conducted for a contractor’s task.
A contract worker cut through an unlabelled pipe, which contained flammable gas, as part of building modifications causing a fire. The worker sustained burns to his arm and head before jumping from the mezzanine deck to escape the fire.
The court noted the company had a sophisticated safety program in place, but failed to ensure its own policies were followed. It was also reported the contractor unlawfully removed the guard from his concrete cutter and failed to conduct his own risk assessment prior to commencement of work.
