New Safety Regulations in NSW

The NSW government have released the Work Health and Safety Regulation 2025.

The previous WHS Regulation 2017 was scheduled to be automatically repealed on 1st September 2025, therefore it was necessary to introduce the new set of safety regulations. The new regulations also consolidate numerous amendments made since introduction of the 2017 regulations, including the psychosocial and demolition amendments.

Some of the changes in the new regulations include:

  • Certified safety system now refers to AS / ISO 45,001:2018 OHS Mgt Systems, instead of AS 4801: 2001.

  • A VET course now applies for air monitoring clearance inspections for asbestos removal work.

  • Managing psychosocial risks must be in accordance with prescribed controls.

  • Demolition licence now requires the supervisor to be “present”, and workers to complete demolition induction training.

  • Duty to determine if electrical equipment is de-energised to be by a “competent person”.

  • Definition for food delivery work is included.

  • Food delivery riders to complete food delivery induction and provided with personal protective equipment (PPE) before booking provider is to allocate delivery tasks, and records to be kept for 5 years.

  • Food delivery riders have a duty to wear high-viz PPE.

  • Retroreflective road safety high-viz garments standard updated to AS 1906.4: 2023.

  • Definition for electric scooter has been inserted.

  • Fall arrest systems for tree lopping amended to AS 1891.1: 2020.

  • Labelling of hazardous materials definition updated to Therapeutic Goods (Poisons Standard), as in force from time to time.

  • Lithium Emergency plans to be in place for sites storing or handling 25,000kg or more of lithium-ion batteries.

  • Amended exceptions for Confidentiality of Information for administration or law enforcement.
