Declare Use of AI

A recent court case has highlighted the need for official submissions and company documents to declare use of artificial intelligence (AI).

This particular case involved a HR employee and director who utilised AI to prepare an appeal against a worker’s compensation claim. The employer’s director conceded she used AI to prepare her submissions because they couldn’t afford a lawyer.

In the NSW Personal Injury Commission, it became apparent the director’s submission included an incorrect case citation and multiple legal claims based on incorrect statutory references, including one that contended the insurer had breached insurance-contract law that didn’t apply to workers’ compensation.

The Commission stated such use of undisclosed use of AI could undermine the fairness and integrity of proceedings, and lack of finance for legal challenges did not lessen the obligation to comply with rules for AI use.

The lesson for all safety professionals is to exercise caution with use of AI, including; cross-check important information and validate all references.

It is much safer to declare any use of AI in preparing important company documents. We recommend at least a small foot note to acknowledge your sources.
