Worker Wins Back Job

A FedEx worker sacked for carelessly dropping a package containing dangerous goods, which caused acid to spill, has won his job back.

The NSW Fair Work Commission (FWC) agreed the workers conduct was sufficiently serious to warrant dismissal, but found he had been treated less favourably than other workers breaching the same or similar company rules and procedures.

Damning evidence was presented of CCTV footage from the workplace showing other workers throwing and kicking packages, placing dangerous goods unsafely on a conveyor, and people climbing over the conveyor. None of these workers were sacked.

The lesson from this case is clear, we need to be consistent with our enforcement of safety rules, and to be fair and just when discipline is required.
